Under the 2018 Farm Bill, hemp is defined as the plant Cannabis sativa L. and any part of that plant, including its seeds and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, with a delta-9 tetrahydrocannabinol (THC) concentration of not more than 0.3% on a dry weight basis. This definition has allowed for the legal sale of hemp-derived products containing less than 0.3% delta-9 THC.

However, recent developments have introduced complexities:

  • THCA (Tetrahydrocannabinolic Acid): THCA is a non-intoxicating precursor to THC. When heated, it converts to delta-9 THC. The Drug Enforcement Administration (DEA) clarified in May 2023 that THCA should be considered in the total THC calculation, potentially classifying high-THCA products as controlled substances if they exceed the 0.3% threshold when decarboxylated.

  • 2024 Farm Bill Proposals: Proposed amendments to the 2024 Farm Bill aim to redefine hemp to include "total THC," encompassing THCA in the THC concentration limit. If enacted, this could render many hemp-derived products non-compliant with federal law, affecting their legality and availability.

Given these developments, the legal status of certain hemp-derived products, including those containing THCA, is subject to change. House of Ounce advises consumers to stay informed about federal and state regulations and to consult legal counsel for guidance.
